What is a Builders Warranty?
New York State Requires Builders to Provide All New Construction Homes with a Warranty
I frequently get asked “if” a Home Warranty is included when showing New Construction Homes. The expectations are not always there that a warranty even exists. I have actually found that to be a bit surprising. New York State law has taken away a good deal of the concerns as it requires the builders to provide a warranty on all new construction homes. New York State law works to protect the consumer by placing specific requirements on the builders of how the warranty works, and is required to be included for all homes that fall into this category.
All Builders Must Provide a New Home Warranty. This is a New York State Law for quite some time now. It protects the buyers from all sorts of defects. Please be sure to read the details of your warranty. Filing for any repairs must be done as stated. Deadlines are important as once a specific time frame is past then the issues are not covered.
- One year’s protection against faulty workmanship and defective materials
- Two year’s protection against defective installation of the plumbing, electrical, heating and cooling systems
- Six year’s protection against structural defects
A copy of the details is sent over to the buyers attorney along with contracts. Your actual warranty is given at the transfer of title. The details explain the process for any grievance and how to handle any problems along the way. Important to look for is the deadlines any protocol for the process. The warranty does not cover any additional construction done by the homeowner after closing.
